Signing the building contract

The Contrat de Construction de Maison Individuelle (CCMI) (detached home building contract) is the best contract currently on the market. It offers complete protection for the client.

The CCMI is a contract governed by the law of 1990 – Chapter 1 – and includes a house plan.
It includes the ‘notice d’information’ (explanatory section setting out your rights and responsibilities and those of the contractor), the special conditions and the general conditions.

The essential features of the building contract are :

  • A single contact person;
  • 3 deadlines that must be kept to;
  • 5 condition precedents that must be met for construction to go ahead;
  • Various insurance policies: guarantee to complete the building project at the price and within the timescale agreed on (linked to performance bond), client’s insurance cover, comprehensive professional liability cover (ten year warranty and third party coverage), defects liability period and two year post delivery guarantee.

The legal framework of this contract details:

  • The identity and civil status of the client;
  • The identity and civil status of the contractor;
  • The exact location of the building plot and the model of the property being constructed;
  • The solicitor’s contact details;
  • The cost of the building to be constructed, the price agreed upon and the cost of works to be paid for by the client;
  • The indexation to be applied
  • The financing of the project;
  • The conditions and cost of the client’s insurance cover (dommages ouvrage);
  • The institution that provides the surety bond service (le garant);
  • The place and date of the contract signing;
  • The documentation that was provided (detailed description of construction project and house plan);
  • The signatures of the contract signatories.

The law stipulates that the customer may make use of a seven day ‘cooling-off’ period, as laid down in the Code de la consommation (Consumer Code).
